Consent to Receive Electronic Disclosures
In this Consent to Receive Electronic Disclosures, “you” and “your” refer to each customer who applies for a loan or deposit product from us and, if approved, receives a loan and a deposit product from us; "we," "us" and "our" refer to Plannery, Inc. All deposits are held at Emprise Bank, Member FDIC.
We need to provide you with certain disclosures and information concerning your loan and deposit transaction. In order to deliver these disclosures and information to you in an electronic format, you must first read this Consent to Receive Electronic Disclosures and affirmatively consent to receive disclosures electronically. Your consent to receive electronic disclosures allows us to give you federal and state disclosures concerning your loan transaction in the electronic format described below and to communicate with you electronically. Please read this consent carefully. Consent is required to proceed in your transaction with us. If you do not wish to consent to receive such information in electronic format, you should not consent, and the transaction will not proceed any further.
Records Covered by Consent; Electronic Signature: By consenting to receive electronic disclosures, you agree that we may send you communications, information and disclosures concerning your loan and deposit application and, if approved, your loan and deposit transaction electronically (“Records”). The Records will include information concerning our decision on your credit application, including adverse action notices under the federal Equal Credit Opportunity Act and the federal Fair Credit Reporting Act. If we decide to extend credit to you, the Records will also include a loan note and related Truth in Lending disclosures and may include a Payroll Deduction Authorization and/or ACH Authorization for payment of your account. If you are approved to open a deposit account to facilitate loan payments, the Records will also include disclosures and periodic statements related to the Truth in Savings Act and the Electronic Funds Transfer Act.
You agree to execute all documents to be signed in connection with your loan transaction with an electronic signature.
Receiving a Paper Copy: You may request a paper copy of the Records by emailing us at support@planneryapp.com. You will not be charged a fee for the first paper copy of a Record. We will provide additional paper copies to you for $15 per copy.
Withdrawing Your Consent to Receive Electronic Records: You may withdraw your consent to receive electronic Records, by emailing us at support@planneryapp.com. Your withdrawal of consent will be effective as soon as possible, but no later than 10 business days after we receive a request as provided above. Subsequent to the withdrawal of your consent, we will mail paper copies of all documents, including but not limited to loan and deposit account statements, disclosures and notices. You will be charged a fee of $5 per month to cover the cost of processing and mailing you paper documents.
Hardware and Software Requirements: In order to receive, access and retain Records electronically, you will need to have the following hardware and software:
* A computer, mobile device, tablet, or other device with Internet access;
* An Internet web browser which is capable of supporting 128-bit encryption;
* An active email account;
* Software that permits you to receive and view Portable Document Format (PDF) files, such as Adobe Acrobat Reader (available for free download at http://get.adobe.com/reader/); and
* Ability to print from your computer, mobile device, tablet, or other device and/or download and store documents on your computer, mobile device, tablet, or other device.
Your Contact Information: You agree to provide us with your current email address so that we may communicate with you electronically. You must promptly notify us of any change to your email address by e-mailing support@planneryapp.com. If you give us an incorrect email address or fail to update or correct your email address, an electronic Communication will be deemed provided to you if we use the email address in our records for the electronic Communication.
